Terms of Service

These Terms of Service ("Terms") govern your access to and use of EmuDock (the "Service"), available at https://emudock.com. The Service is a browser-based retro game emulator that streams curated game software (and any required BIOS) to your browser and runs it locally. The Service is free to use — there are no paid plans, subscriptions, or fees. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
1. Acceptance of These Terms
By creating an account, signing in, or otherwise using the Service, you acknowledge that you have read, understood, and agree to these Terms and to our Privacy Policy. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Eligibility
You must be at least 13 years old, or the minimum age of digital consent in your jurisdiction, to use the Service. You must not use the Service if doing so is prohibited by applicable law. By using the Service, you represent that you meet these requirements.
3. User Accounts
Some features of the Service require an account. You may register using an email address and password, or sign in with Google. You agree to provide accurate and complete information when registering and to keep that information current. You are responsible for all activity that occurs under your account.
4. Account Security
You are responsible for safeguarding your password and for any credentials associated with your account. You must not share your credentials with others or allow others to use your account. If you suspect unauthorized access to your account, contact us promptly at support@emudock.com.
5. Acceptable Use and Prohibited Conduct
You agree not to misuse the Service. Prohibited conduct includes:
- using the Service in violation of any applicable law or regulation;
- attempting to interfere with, disrupt, or gain unauthorized access to the Service, its systems, or other users' accounts;
- reverse engineering, decompiling, or attempting to derive the source code of the Service;
- uploading malicious code, viruses, or other harmful material;
- scraping, harvesting, or collecting data from the Service without authorization;
- using the Service to store or distribute unlawful, infringing, or abusive material;
- downloading, recording, re-streaming, redistributing, or reselling game content made available through the Service's content library; and
- impersonating any person or entity or misrepresenting your affiliation.
6. Content Library and Copyrighted Material
EmuDock operates a curated content library: games and any required BIOS files are streamed to your browser from our servers and run locally in the emulator. You may use library content for personal, non-commercial play within the Service only. You may not download, record, copy, redistribute, sell, or otherwise use library content outside the Service (see Section 5).
If you play a game file or BIOS from your own device, you are solely responsible for ensuring that you have the legal right to use it (for example, that you own it or are otherwise authorized to play it). By playing or providing such material, you represent that you are authorized to do so.
We curate the content available in the library and may add, replace, or remove titles at any time. We respond to valid takedown requests in accordance with applicable law and may remove content or suspend or terminate accounts where material infringes intellectual property rights.
The Service may display game-related artwork or metadata for catalog and interface purposes. Ownership and licensing of such material rests with its respective owners, and we make no claim of ownership over it.
7. Cloud Saves (Google Drive)
Cloud saves are an optional feature that lets you connect your own Google Drive to store personal emulator save data (battery saves, save states, and related files). Connecting Drive is a separate authorization flow, distinct from signing in with Google. When connected, the Service manages an "EmuDock" folder in your Drive under Google's drive.file scope and accesses only that folder — never your other Drive files.
Cloud saves are governed by these Terms together with your provider's (Google's) terms. You are responsible for your provider account and for what you choose to sync. You can disconnect Drive or delete the EmuDock folder at any time.
8. Service Availability
We aim to keep the Service available, but the Service is provided "as is" and "as available." We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free. We may perform maintenance, and the Service may experience downtime or interruptions from time to time.
9. Modification or Discontinuation of the Service
We may modify, update, or discontinue features of the Service, in whole or in part, at any time. We will make reasonable efforts to provide notice of material changes or discontinuation where practicable, but do not guarantee that all features will be available indefinitely.
10. Account Suspension and Termination
We may suspend or terminate your access to the Service if you violate these Terms, engage in illegal activity, or otherwise pose a risk to the Service or its users. You may stop using the Service at any time. To request account deletion, contact us at support@emudock.com.
11. Intellectual Property
The Service's software, design, branding ("EmuDock"), and related materials are owned by or licensed to us and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of the Service except as expressly permitted. You retain whatever rights you have in content you provide. Game titles, artwork, and other third-party material remain the property of their respective owners.
12. Third-Party Services
The Service depends on third-party services, including Supabase (authentication and database), Cloudflare (hosting, DNS, and content delivery), and Google (for Google sign-in), and may use a transactional email provider in the future. Your use of those services (for example, a Google account) is governed by their respective terms and privacy policies, and your use of the Service is subject to their availability.
13. Disclaimers
The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will meet your requirements, be uninterrupted, secure, or error-free, or that any results obtained from the Service will be accurate or reliable.
14. Limitation of Liability
To the maximum extent permitted by law, EmuDock and its service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits or data, arising out of or relating to your use of, or inability to use, the Service. To the maximum extent permitted by law, our total aggregate liability will not exceed US$100 — the Service is free, so this is the outer limit in all cases. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
15. Indemnification
To the maximum extent permitted by law, you agree to indemnify and hold harmless EmuDock and its service providers from and against any claims, liabilities, damages, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your content (including any ROMs, BIOS files, or other material you play or provide), or your violation of these Terms or applicable law.
16. Governing Law
These Terms are governed by the laws of Canada and the province or territory in which the operator of EmuDock resides, without regard to conflict-of-law principles. If you reside outside of Canada, you may have additional rights under the laws of your country of residence, and nothing in these Terms limits rights that cannot be waived by contract.
17. Changes to These Terms
We may revise these Terms from time to time. Material changes will be posted on this page with an updated "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
